उत्तराखंड में दूसरी बार मुख्यमंत्री बने पुष्कर सिंह धामी ने राज्य में यूनिफॉर्म सिविल कोड लागू करने की तरफ कदम बढ़ा दिया है। धामी ने विधानसभा चुनाव से ठीक पहले यह मुद्दा उठाया था। गुरुवार को धामी कैबिनेट की पहली बैठक में यूनिफॉर्म सिविल कोड लागू करने के लिए विशेषज्ञों की एक उच्च स्तरीय समिति बनाने का निर्णय लिया गया। समिति की अध्यक्षता सुप्रीम कोर्ट अथवा हाईकोर्ट के रिटायर्ड जस्टिस करेंगे। यह समिति यूनिफॉर्म सिविल कोड का ड्राफ्ट तैयार करेगी।
यूनिफॉर्म सिविल कोड उत्तराखंड के सभी नागरिकों पर समान रूप से लागू होगा चाहे वे किसी भी धर्म में विश्वास रखते हों। यह व्यक्तिगत नागरिक मामलों जैसे विवाह, तलाक, सम्पत्ति के अधिकार, उत्तराधिकार, गोद लेने और संरक्षता आदि को प्रभावित करेगा।
कैबिनेट के फैसलों की जानकारी देते हुए मुख्यमंत्री पुष्कर सिंह धामी ने कहा कि उत्तराखंड में जल्द ही यूनिफॉर्म सिविल कोड लागू किया जाएगा। इसके लिए सेवानिवृत्त जजों, समाज के प्रबुद्ध जनों और अन्य पक्षों की एक कमेटी गठित होगी जो सिविल कोड का ड्राफ्ट तैयार करेगी। समान नागरिक संहिता का दायरा विवाह-तलाक, गोद लेने और उत्तराधिकार जैसे विषयों तक होगा। इसके लिए पर्सनल लॉ की समीक्षा की जाएगी।
मुख्यमंत्री धामी ने कहा कि यूनिफॉर्म सिविल कोड संविधान निर्माताओं के सपनों को पूरा करने की दिशा में एक अहम कदम होगा। यह भारतीय संविधान के आर्टिकल 44 की दिशा में भी एक प्रभावी कदम होगा, जो देश के सभी नागरिकों के लिए समान नागरिक संहिता की संकल्पना प्रस्तुत करता है। सर्वोच्च न्यायालय ने भी समय-समय पर इसे लागू करने पर जोर दिया है। धामी ने कहा कि इस महत्वपूर्ण निर्णय में गोवा राज्य से भी प्रेरणा मिलेगी, जिसने एक प्रकार का यूनिफॉर्म सिविल कोड लागू कर देश में एक उदाहरण पेश किया है।
धामी ने दावा किया कि यूनिफॉर्म सिविल कोड लागू होने से राज्य के सभी नागरिकों के लिए समान अधिकारों को बल मिलेगा। इससे राज्य में सामाजिक समरसता बढ़ेगी और जेंडर जस्टिस को भी बढ़ावा मिलेगा। उत्तराखंड का यूनिफॉर्म सिविल कोड दूसरे राज्यों के लिए भी उदाहरण बन सकता है।
